These Terms and Conditions govern your use of Haoskyer's yacht charter services and website. By booking a charter or using our services, you agree to these terms.

1. Company Information

Haoskyer is a yacht charter company incorporated under the laws of British Columbia, Canada. Our registered office is located at 1680 Bayshore Drive, Vancouver, BC V6G 3H3, Canada.

2. Service Description

Haoskyer provides yacht charter services including but not limited to:

  • Private yacht charters with professional crew
  • Corporate event hosting on chartered vessels
  • Wedding and celebration services
  • Custom charter packages and experiences
  • Additional services such as catering, photography, and equipment rental

All services are subject to availability, weather conditions, and compliance with Canadian maritime regulations.

3. Booking and Reservations

3.1 Booking Process

Charter reservations require a signed charter agreement and payment of applicable deposits. All bookings are subject to confirmation by Haoskyer and vessel availability.

3.2 Pricing and Payment

Charter rates are quoted in Canadian dollars and include the services specified in your charter agreement. Additional costs may apply for:

  • Fuel consumption beyond included allowances
  • Docking and marina fees
  • Catering and beverage services
  • Special equipment rental
  • Extended charter hours
  • Crew gratuities (recommended 10-15% of charter fee)

3.3 Deposit and Final Payment

A deposit of 50% of the total charter fee is required to secure your reservation. Final payment is due 14 days prior to charter commencement. Failure to make final payment may result in charter cancellation without refund.

4. Cancellation Policy

4.1 Guest Cancellations

Cancellation fees apply as follows:

  • More than 30 days before charter: Full refund minus 10% administrative fee
  • 15-30 days before charter: 50% refund of total charter fee
  • 7-14 days before charter: 25% refund of total charter fee
  • Less than 7 days before charter: No refund

4.2 Weather Cancellations

If weather conditions are deemed unsafe by the Captain, charters may be cancelled or modified. In such cases, guests will receive a full refund or the option to reschedule at no additional cost.

4.3 Company Cancellations

Haoskyer reserves the right to cancel charters due to mechanical issues, safety concerns, or force majeure events. Full refunds will be provided, and we will make reasonable efforts to arrange alternative accommodations.

5. Safety Requirements and Guest Responsibilities

5.1 Safety Compliance

All guests must comply with safety briefings and instructions from the Captain and crew. Failure to follow safety protocols may result in charter termination without refund.

5.2 Age and Health Requirements

Guests under 18 must be accompanied by a parent or guardian. Guests with medical conditions that may affect their ability to safely participate in charter activities must disclose such conditions prior to embarkation.

5.3 Guest Conduct

Guests are expected to conduct themselves responsibly and respectfully. Excessive alcohol consumption, illegal drug use, or behavior that endangers safety or disturbs other guests may result in immediate charter termination.

6. Limitation of Liability

6.1 Company Liability

Haoskyer's liability is limited to the total charter fee paid. We are not liable for indirect, consequential, or punitive damages including but not limited to loss of enjoyment, business losses, or travel expenses.

6.2 Guest Responsibility

Guests participate in charter activities at their own risk and are responsible for any damage to vessel property caused by their actions or negligence.

6.3 Insurance Requirements

Guests are strongly advised to obtain travel insurance covering charter activities. Haoskyer maintains comprehensive marine insurance but guest personal property and medical expenses are not covered.

7. Force Majeure

Neither party shall be liable for delays or failures in performance resulting from acts beyond their reasonable control, including but not limited to natural disasters, government actions, labor disputes, or other circumstances constituting force majeure.

8. Intellectual Property

All content on the Haoskyer website, including text, images, logos, and design elements, is protected by copyright and trademark laws. Guests may not reproduce, distribute, or commercially use this content without written permission.

9. Privacy and Data Protection

Guest information is collected and used in accordance with our Privacy Policy. By booking our services, you consent to the collection and use of your personal information as described in our Privacy Policy.

10. Dispute Resolution

10.1 Governing Law

These Terms and Conditions are governed by the laws of British Columbia, Canada, and Canadian federal maritime law.

10.2 Dispute Resolution Process

Disputes shall first be addressed through good faith negotiation. If unresolved, disputes shall be subject to binding arbitration under the rules of the British Columbia International Commercial Arbitration Centre.

11. Environmental Responsibilities

Guests are expected to respect marine environments and follow all environmental guidelines provided by the crew. This includes proper waste disposal, wildlife viewing protocols, and adherence to protected area regulations.

12. Modifications and Updates

Haoskyer reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted on our website with the revision date. Continued use of our services constitutes acceptance of updated terms.

13. Severability

If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions shall remain in full force and effect.
